Cerebral Palsy Birth Injuries Require A Lifetime of Care

Cerebral palsy is the most common developmental disability among children in the United States. Cerebral palsy is a a neurological disorder that hinders body movement and muscle coordination. Cerebral palsy symptoms can be mild or severe. They include lack of movement  and limb control, including spastic, rigid, slow or shaky arms and legs. The condition can also impair brain function, vision and hearing.

Twenty percent of the time, cerebral palsy is caused by a lack of oxygen to an infant's brain during labor or delivery.  Often, these children require medicine, surgeries, therapies and adaptive equipment for the rest of their lives. A lifetime of such care is costly in terms of both time and money.

Last year a Wake County (NC) jury awarded over $9 million for a child who suffered cerebral palsy after a botched delivery. The permanent brain injury to the child left him needing round-the-clock care for the rest of his life. The allegations were that an inexperienced labor & delivery nurse and an inattentive doctor led to the mother experiencing a placental abruption, which left the child without oxygen or nutrients.

Another North Carolina case in which a child was left with cerebral palsy, seizures and developmental delays after negligent labor and delivery treatment settled for more than $3 million last year. The allegations were that the hospital personnel failed to timely respond when the baby started showing signs of distress. The child was left with injuries that will require life-long medical treatment and care.
